Gjykata e Apelit Shkod\u00ebr, ka vendosur prishjen e vendimit t\u00eb Gjykat\u00ebs s\u00eb Rrethit Gjyq\u00ebsor Shkod\u00ebr me arsyetimin se padit\u00ebsi duhet t\u00eb ngrinte padin\u00eb e rivendikimit. P\u00ebr pasoj\u00eb vendimi i k\u00ebsaj gjykate duhet t\u00eb prishet dhe \u00e7\u00ebshtja t\u00eb kthehet p\u00ebr rishqyrtim pran\u00eb Gjykat\u00ebs s\u00eb Apelit t\u00eb Juridiksionit t\u00eb P\u00ebrgjithsh\u00ebm.<\/p>\r\n        <\/article>\r\n\r\n        <!-- ENGLISH -->\r\n        <article id=\"lang-en\" class=\"content-section\">\r\n            <h2 class=\"serif text-3xl text-[var(--brown-deep)] mb-8 border-b border-[var(--gold)]\/20 pb-4\">Decision no. 00-2025-3686, dated 28.10.2025 of the Civil College<\/h2>\r\n            \r\n            <p class=\"drop-cap\">In cases of illegal construction on the owner's land by a public body, since the land estate has not vanished but has merged with the building to create a single item, the court must consider the landowner's request for the recognition of property rights over specific parts of the building in the possession of the public body, rather than dismissing the lawsuit on the grounds that the plaintiff should have filed a claim for restitution (reivindicatio).<\/p>\r\n\r\n            <p>With the decision of the Property Restitution and Compensation Commission of Shkodra Municipality, in favor of the heirs (of whom the plaintiff is part), a plot of land of 3910 m\u00b2 was returned, registered with the Shkodra Mortgage Office on 27.04.1994. By the Council of Territorial Regulation of Shkodra Municipality, on 16.06.1993, a construction permit was granted for a 6-story building with two sections, included in the land returned to the former owners.<\/p>\r\n            \r\n            <p>After the construction of the object, the National Housing Entity registered the title of ownership in its favor, and subsequently, the apartments included in the building in question were distributed to persons who benefit from the \"homeless\" status. The plaintiff approached the court with a lawsuit directed against the defendants, the Municipality of Shkodra and the Regional Directorate of the National Housing Entity, seeking the obligation to recognize the plaintiff as a co-owner of the constructed object.<\/p>\r\n\r\n            <div class=\"case-card p-8 rounded-2xl mb-10 shadow-lg\">\r\n                <h3 class=\"serif text-xl font-bold mb-4\">Court Reasoning<\/h3>\r\n                <p>The Shkodra District Court rejected the lawsuit, assessing that the construction is illegal. The Shkodra Court of Appeal decided to overturn the District Court's decision, arguing that the plaintiff should have filed a claim for restitution. The Civil Chamber of the Supreme Court (KCGJL) assesses that the dispute relates to the subjective right of ownership and its protection against illegal interventions by third parties or public bodies.<\/p>\r\n            <\/div>\r\n\r\n            <p>According to Article 41 and following of the Constitution, several forms of compensation for the right of ownership are recognized, which are the result of legal expropriation by the state, either by payment in value in cases of impossibility of returning the object, or with construction units in cases where the land is invested for construction.<\/p>\r\n\r\n            <p>Considering that the claimed service units were still owned by the state, the court of appeal must provide an exhaustive answer in the retrial to the plaintiff's requests regarding whether or not they can judicially restore the subjective right of ownership over the land affected by the defendant's construction, and whether they had chosen the appropriate procedural remedy to realize this right. Consequently, the decision of that court must be overturned and the case returned for retrial to the Court of Appeal of General Jurisdiction.<\/p>\r\n        <\/article>\r\n\r\n        <!-- ITALIAN -->\r\n        <article id=\"lang-it\" class=\"content-section\">\r\n            <h2 class=\"serif text-3xl text-[var(--brown-deep)] mb-8 border-b border-[var(--gold)]\/20 pb-4\">Sentenza n. 00-2025-3686, del 28.10.2025 del Collegio Civile<\/h2>\r\n            \r\n            <p class=\"drop-cap\">Nei casi di interventi illegali con costruzione sul terreno del proprietario da parte di un ente pubblico, dato che il bene immobile (terreno) non \u00e8 andato perduto, ma \u00e8 stato unito all'edificio creando un'unica entit\u00e0, il tribunale deve considerare la richiesta del proprietario del terreno per il riconoscimento del diritto di propriet\u00e0 su singole parti dell'edificio in possesso dell'ente pubblico, invece di respingere l'azione con la motivazione che il ricorrente avrebbe dovuto presentare un'azione di rivendicazione.<\/p>\r\n\r\n            <p>Con la decisione della Commissione di Restituzione e Compensazione delle Propriet\u00e0 del Comune di Scutari, a favore degli eredi (di cui fa parte anche il ricorrente), \u00e8 stata restituita una superficie di terreno di 3910 m\u00b2, registrata presso l'Ufficio Ipotecario di Scutari in data 27.04.1994. Da parte del Consiglio di Regolazione del Territorio del Comune di Scutari, in data 16.06.1993, \u00e8 stato rilasciato un permesso di costruzione per un palazzo di 6 piani con due sezioni, incluso nel terreno restituito agli ex proprietari.<\/p>\r\n            \r\n            <p>Dopo la costruzione dell'oggetto, l'Ente Nazionale degli Alloggi ha registrato il titolo di propriet\u00e0 a suo favore e successivamente, gli appartamenti inclusi nell'edificio in questione sono stati distribuiti a persone aventi diritto allo status di \"senza tetto\". Il ricorrente si \u00e8 rivolto al tribunale con un'azione diretta contro i convenuti, il Comune di Scutari e la Direzione Regionale dell'Ente Nazionale degli Alloggi, chiedendo l'obbligo di riconoscimento della compropriet\u00e0 sull'oggetto costruito.<\/p>\r\n\r\n            <div class=\"case-card p-8 rounded-2xl mb-10 shadow-lg\">\r\n                <h3 class=\"serif text-xl font-bold mb-4\">Ragionamento della Corte<\/h3>\r\n                <p>Il Tribunale Distrettuale di Scutari ha respinto l'azione, valutando che la costruzione fosse illegale. La Corte d'Appello di Scutari ha deciso di annullare la decisione del Tribunale Distrettuale con la motivazione che il ricorrente avrebbe dovuto presentare un'azione di rivendicazione. Il Collegio Civile della Corte Suprema (KCGJL) valuta che la controversia riguarda il diritto soggettivo di propriet\u00e0 e la sua tutela contro interventi illegali da parte di terzi o enti pubblici.<\/p>\r\n            <\/div>\r\n\r\n            <p>Secondo l'articolo 41 e seguenti della Costituzione, sono riconosciute diverse forme di compensazione del diritto di propriet\u00e0, che sono il risultato dell'esproprio legale da parte dello Stato, sia con il pagamento in valore nei casi di impossibilit\u00e0 di restituzione del bene, sia con unit\u00e0 immobiliari nei casi in cui il terreno viene investito per la costruzione.<\/p>\r\n\r\n            <p>Considerando il fatto che le unit\u00e0 di servizio reclamate erano ancora di propriet\u00e0 dello Stato, la corte d'appello deve fornire nel nuovo giudizio una risposta esaustiva alle richieste della parte ricorrente circa la possibilit\u00e0 o meno di ripristinare in via giudiziaria il diritto soggettivo di propriet\u00e0 sul terreno inciso dalla costruzione della parte convenuta e se avesse scelto il mezzo procedurale corretto per realizzare tale diritto. Decision no. 00-2025-3686, dated 28.10.2025 of the Civil College In cases of illegal construction on the owner&#8217;s land by a public body, since the land estate has not vanished but has merged with the building to create a single item, the court must consider the landowner&#8217;s request for the recognition of property rights over specific parts of the building in the possession of the public body, rather than dismissing the lawsuit on the grounds that the plaintiff should have filed a claim for restitution (reivindicatio). With the decision of the Property Restitution and Compensation Commission of Shkodra Municipality, in favor of the heirs (of whom the plaintiff is part), a plot of land of 3910 m\u00b2 was returned, registered with the Shkodra Mortgage Office on 27.04.1994. By the Council of Territorial Regulation of Shkodra Municipality, on 16.06.1993, a construction permit was granted for a 6-story building with two sections, included in the land returned to the former owners. After the construction of the object, the National Housing Entity registered the title of ownership in its favor, and subsequently, the apartments included in the building in question were distributed to persons who benefit from the &#8220;homeless&#8221; status. The plaintiff approached the court with a lawsuit directed against the defendants, the Municipality of Shkodra and the Regional Directorate of the National Housing Entity, seeking the obligation to recognize the plaintiff as a co-owner of the constructed object. Court Reasoning The Shkodra District Court rejected the lawsuit, assessing that the construction is illegal. The Shkodra Court of Appeal decided to overturn the District Court&#8217;s decision, arguing that the plaintiff should have filed a claim for restitution. The Civil Chamber of the Supreme Court (KCGJL) assesses that the dispute relates to the subjective right of ownership and its protection against illegal interventions by third parties or public bodies. According to Article 41 and following of the Constitution, several forms of compensation for the right of ownership are recognized, which are the result of legal expropriation by the state, either by payment in value in cases of impossibility of returning the object, or with construction units in cases where the land is invested for construction. Considering that the claimed service units were still owned by the state, the court of appeal must provide an exhaustive answer in the retrial to the plaintiff&#8217;s requests regarding whether or not they can judicially restore the subjective right of ownership over the land affected by the defendant&#8217;s construction, and whether they had chosen the appropriate procedural remedy to realize this right. Consequently, the decision of that court must be overturned and the case returned for retrial to the Court of Appeal of General Jurisdiction.
