R\u00ebnd\u00ebsia e tij \u00ebsht\u00eb shtuar ve\u00e7an\u00ebrisht gjat\u00eb periudh\u00ebs s\u00eb tranzicionit t\u00eb pron\u00ebsis\u00eb pas vitit 1991, kur nj\u00eb num\u00ebr i konsideruesh\u00ebm marr\u00ebdh\u00ebniesh juridike mbi pasurit\u00eb e paluajtshme u zhvilluan n\u00eb munges\u00eb t\u00eb formalizimit t\u00eb plot\u00eb ligjor, p\u00ebrmes kontratave informale, marr\u00ebveshjeve t\u00eb simuluara ose posedimeve afatgjata.<\/p>\r\n\r\n            <p>Jurisprudenca e Gjykat\u00ebs s\u00eb Lart\u00eb ka luajtur rol vendimtar n\u00eb konsolidimin e standardeve interpretative t\u00eb nenit 168 t\u00eb Kodit Civil, duke trajtuar problematika q\u00eb lidhen me natyr\u00ebn e titullit juridik, simulimin e kontratave, mir\u00ebbesimin e poseduesit, efektet e AMTP-s\u00eb dhe kufijt\u00eb e qarkullimit civil.<\/p>\r\n\r\n            <p>Analiza e k\u00ebtyre vendimeve tregon nj\u00eb evolucion t\u00eb jurisprudenc\u00ebs drejt mbrojtjes s\u00eb realitetit juridik dhe faktik t\u00eb posedimit, pa cenuar sigurin\u00eb juridike dhe rregullat themelore t\u00eb qarkullimit civil.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">II. Kuptimi juridik i parashkrimit fitues<\/p>\r\n            <p>Parashkrimi fitues \u00ebsht\u00eb m\u00ebnyr\u00eb origjinare e fitimit t\u00eb pron\u00ebsis\u00eb n\u00ebp\u00ebrmjet posedimit t\u00eb nj\u00eb sendi p\u00ebr nj\u00eb periudh\u00eb t\u00eb caktuar kohe dhe n\u00eb kushtet e parashikuara nga ligji.<\/p>\r\n\r\n            <div class=\"bg-white p-5 sm:p-8 rounded-xl md:rounded-2xl border-l-4 md:border-l-8 border-gold shadow-md my-8 md:my-10\">\r\n                <h3 class=\"serif text-lg sm:text-xl mb-3 md:mb-4 font-bold text-brown-deep\">Sipas nenit 168 t\u00eb Kodit Civil, pron\u00ebsia fitohet kur:<\/h3>\r\n                <ul class=\"space-y-3 pl-3 md:pl-4 border-l border-gold\/30 italic text-espresso text-sm sm:text-base\">\r\n                    <li>\u2022 ekziston nj\u00eb veprim juridik q\u00eb ka p\u00ebr q\u00ebllim kalimin e pron\u00ebsis\u00eb;<\/li>\r\n                    <li>\u2022 poseduesi \u00ebsht\u00eb n\u00eb mir\u00ebbesim;<\/li>\r\n                    <li>\u2022 posedimi ka vazhduar p\u00ebr 10 vjet pa nd\u00ebrprerje.<\/li>\r\n                <\/ul>\r\n            <\/div>\r\n\r\n            <p>Nd\u00ebrsa sipas nenit 169 t\u00eb Kodit Civil, n\u00eb munges\u00eb t\u00eb titullit dhe mir\u00ebbesimit k\u00ebrkohet posedim 20-vje\u00e7ar.<\/p>\r\n            <p>Thelbi i institutit q\u00ebndron n\u00eb mbrojtjen e stabilitetit juridik dhe t\u00eb situatave faktike t\u00eb konsoliduara n\u00eb koh\u00eb.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">III. Kuptimi i \u201cveprimit juridik\u201d sipas nenit 168 KC<\/p>\r\n            <p>Nj\u00eb nga \u00e7\u00ebshtjet m\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb trajtuara nga Kolegji Civil lidhet me kuptimin e shprehjes:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-4 font-serif\">\u00ab\u201cveprim juridik q\u00eb ka p\u00ebr q\u00ebllim kalimin e pron\u00ebsis\u00eb\u201d.\u00bb<\/p>\r\n            <p>Gjykata e Lart\u00eb ka sqaruar se kjo shprehje duhet interpretuar n\u00eb p\u00ebrputhje me nenin 79 t\u00eb Kodit Civil dhe p\u00ebrfshin vet\u00ebm ato veprime juridike q\u00eb synojn\u00eb transferimin e s\u00eb drejt\u00ebs s\u00eb pron\u00ebsis\u00eb.<\/p>\r\n            \r\n            <p class=\"no-indent\">P\u00ebr rrjedhoj\u00eb:<\/p>\r\n            <ul class=\"space-y-1 pl-5 list-disc mb-6 text-gray-700 text-sm sm:text-base\">\r\n                <li>jo \u00e7do marr\u00ebdh\u00ebnie juridike p\u00ebrb\u00ebn titull;<\/li>\r\n                <li>jo \u00e7do marr\u00ebdh\u00ebnie faktike mund t\u00eb justifikoj\u00eb nenin 168;<\/li>\r\n                <li>duhet t\u00eb ekzistoj\u00eb nj\u00eb akt juridik q\u00eb synon kalimin e pron\u00ebsis\u00eb.<\/li>\r\n            <\/ul>\r\n            <p>Ky interpretim ka r\u00ebnd\u00ebsi themelore sepse p\u00ebrcakton kufijt\u00eb e aplikimit t\u00eb afatit 10-vje\u00e7ar t\u00eb parashkrimit fitues.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">IV. Pavlefshm\u00ebria absolute dhe veprimi i ndaluar nga ligji<\/p>\r\n            <p>Nj\u00eb nga kontributet m\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb jurisprudenc\u00ebs s\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb \u00ebsht\u00eb dallimi nd\u00ebrmjet veprimit juridik absolutisht t\u00eb pavlefsh\u00ebm dhe veprimit juridik t\u00eb ndaluar nga ligji.<\/p>\r\n            <p>Kolegji Civil ka theksuar se jo \u00e7do veprim juridik absolutisht i pavlefsh\u00ebm p\u00ebrb\u00ebn automatikisht veprim t\u00eb ndaluar nga ligji. Ky dallim ka r\u00ebnd\u00ebsi vendimtare p\u00ebr nenin 168 KC.<\/p>\r\n            <p>Nj\u00eb kontrat\u00eb mund t\u00eb jet\u00eb absolutisht e pavlefshme p\u00ebr munges\u00eb forme, p\u00ebr munges\u00eb p\u00eblqimi, ose p\u00ebr munges\u00eb tagrash, por p\u00ebrs\u00ebri t\u00eb konsiderohet titull p\u00ebr efekt t\u00eb parashkrimit fitues, p\u00ebr sa koh\u00eb nuk cenon norma urdh\u00ebruese q\u00eb mbrojn\u00eb interesin publik. Ky standard \u00ebsht\u00eb b\u00ebr\u00eb nj\u00eb nga shtyllat kryesore t\u00eb jurisprudenc\u00ebs moderne mbi parashkrimin fitues.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">V. Simulimi i kontratave dhe kontratat e qiras\u00eb q\u00eb fshehin shitjen<\/p>\r\n            <p>Problematika m\u00eb e shpesht\u00eb n\u00eb praktik\u00ebn shqiptare lidhet me kontratat e qiras\u00eb 30-vje\u00e7are t\u00eb p\u00ebrdorura si forma t\u00eb maskuara shitjeje.<\/p>\r\n            \r\n            <p class=\"font-medium text-brown-deep mt-4\">1. \u00c7\u00ebshtja \u201cDemir Bakana\u00e7i\u201d<\/p>\r\n            <p>N\u00eb vendimin nr. 00-2022-4596 (393), dat\u00eb 26.10.2022, Gjykata e Lart\u00eb analizoi nj\u00eb kontrat\u00eb qiraje ku pal\u00ebt kishin deklaruar se:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-3 font-serif\">\u00abkontrata konsiderohej edhe si kontrat\u00eb shitjeje dhe se pagesa e qiras\u00eb p\u00ebrfaq\u00ebsonte \u00e7mimin e plot\u00eb t\u00eb tok\u00ebs.\u00bb<\/p>\r\n            <p>Gjykata evidentoi se em\u00ebrtimi formal i kontrat\u00ebs nuk ishte vendimtar dhe se duhej analizuar vullneti real i pal\u00ebve. Megjithat\u00eb, Gjykata theksoi se munges\u00eb e p\u00eblqimit t\u00eb t\u00eb gjith\u00eb bashk\u00ebpronar\u00ebve pengonte vlefshm\u00ebrin\u00eb e transferimit t\u00eb pron\u00ebsis\u00eb.<\/p>\r\n\r\n            <p class=\"font-medium text-brown-deep mt-4\">2. \u00c7\u00ebshtja \u201cAlltane Potja\u201d<\/p>\r\n            <p>Nj\u00eb situat\u00eb pothuajse identike paraqitet n\u00eb vendimin nr. 00-2023-718 (116), dat\u00eb 08.03.2023. Kontrata e qiras\u00eb p\u00ebrmbante klauzol\u00eb sipas s\u00eb cil\u00ebs:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-3 font-serif\">\u00abpagesa e qiras\u00eb konsiderohej \u00e7mim shitjeje dhe pal\u00ebt do t\u00eb formalizonin shitjen sapo t\u00eb p\u00ebrfundonin procedurat e regjistrimit.\u00bb<\/p>\r\n            <p>Edhe k\u00ebtu Gjykata u p\u00ebrball me raportin nd\u00ebrmjet simulimit, posedimit dhe parashkrimit fitues.<\/p>\r\n\r\n            <p class=\"font-medium text-brown-deep mt-4\">3. \u00c7\u00ebshtja \u201cP\u00ebllumb Alliu\u201d<\/p>\r\n            <p>N\u00eb vendimin nr. 00-2023-2397 (397), dat\u00eb 14.06.2023, Gjykata analizoi nj\u00eb marr\u00ebdh\u00ebnie t\u00eb ngjashme t\u00eb lindur nga nj\u00eb kontrat\u00eb qiraje afatgjat\u00eb mbi tok\u00eb bujq\u00ebsore t\u00eb p\u00ebrfituar me AMTP.<\/p>\r\n            <p>Nga krahasimi i k\u00ebtyre vendimeve rezulton nj\u00eb parim i p\u00ebrbashk\u00ebt:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-3 font-serif\">\u00absimulimi nuk p\u00ebrjashton automatikisht ekzistenc\u00ebn e titullit p\u00ebr efekt t\u00eb nenit 168 KC; r\u00ebnd\u00ebsi ka q\u00ebllimi real i pal\u00ebve dhe natyra e posedimit.\u00bb<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">VI. Mir\u00ebbesimi dhe keqbesimi<\/p>\r\n            <p>Mir\u00ebbesimi \u00ebsht\u00eb elementi q\u00eb dallon nenin 168 nga neni 169 i Kodit Civil. Its relevance has grown significantly during the property transition period post-1991, where a substantial number of real estate legal relations developed in the absence of full formalization, through informal contracts, simulated agreements, or long-term possession.<\/p>\r\n\r\n            <p>The jurisprudence of the Supreme Court has played a decisive role in consolidating the interpretative standards of Article 168 of the Civil Code, addressing complexities related to the nature of the legal title, contract simulation, possessor's good faith, the effects of the AMTP, and the boundaries of civil circulation.<\/p>\r\n\r\n            <p>The analysis of these decisions reveals an evolution of jurisprudence toward protecting the legal and factual reality of possession without compromising legal certainty and fundamental rules of civil commerce.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">II. Legal Concept of Acquisitive Prescription<\/p>\r\n            <p>Acquisitive prescription is an original method of acquiring ownership through the possession of an item for a specified period of time and under the conditions provided by law.<\/p>\r\n\r\n            <div class=\"bg-white p-5 sm:p-8 rounded-xl md:rounded-2xl border-l-4 md:border-l-8 border-gold shadow-md my-8 md:my-10\">\r\n                <h3 class=\"serif text-lg sm:text-xl mb-3 md:mb-4 font-bold text-brown-deep\">According to Article 168 of the Civil Code, ownership is acquired when:<\/h3>\r\n                <ul class=\"space-y-3 pl-3 md:pl-4 border-l border-gold\/30 italic text-espresso text-sm sm:text-base\">\r\n                    <li>\u2022 there is a legal act aimed at transferring ownership;<\/li>\r\n                    <li>\u2022 the possessor is in good faith;<\/li>\r\n                    <li>\u2022 the possession has continued uninterrupted for 10 years.<\/li>\r\n                <\/ul>\r\n            <\/div>\r\n\r\n            <p>Meanwhile, according to Article 169 of the Civil Code, in the absence of title and good faith, a 20-year possession is required.<\/p>\r\n            <p>The essence of the institute lies in protecting legal stability and factual situations consolidated over time.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">III. The Meaning of \"Legal Act\" according to Article 168 CC<\/p>\r\n            <p>One of the most crucial issues addressed by the Civil Chamber relates to the meaning of the expression:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-4 font-serif\">\u00ab\"legal act aimed at transferring ownership\".\u00bb<\/p>\r\n            <p>The Supreme Court has clarified that this phrase must be interpreted in accordance with Article 79 of the Civil Code and includes only those legal acts that intend to transfer the right of ownership.<\/p>\r\n            \r\n            <p class=\"no-indent\">Consequently:<\/p>\r\n            <ul class=\"space-y-1 pl-5 list-disc mb-6 text-gray-700 text-sm sm:text-base\">\r\n                <li>not every legal relationship constitutes a title;<\/li>\r\n                <li>not every factual relationship can justify Article 168;<\/li>\r\n                <li>a legal instrument aiming at transferring ownership must exist.<\/li>\r\n            <\/ul>\r\n            <p>This interpretation is of fundamental importance because it defines the boundaries of application for the 10-year acquisitive prescription period.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">IV. Absolute Invalidity and Acts Prohibited by Law<\/p>\r\n            <p>One of the most important contributions of the Supreme Court's jurisprudence is the distinction between an absolutely void legal act and a legal act prohibited by law.<\/p>\r\n            <p>The Civil Chamber has emphasized that not every absolutely void legal act automatically constitutes an act prohibited by law. This distinction holds vital importance for Article 168 CC.<\/p>\r\n            <p>A contract may be absolutely void due to lack of form, lack of consent, or lack of authorization\/disposal rights, yet still be considered a valid title for the purpose of acquisitive prescription, as long as it does not violate mandatory provisions that protect the public interest. This standard has become one of the main pillars of modern jurisprudence on acquisitive prescription.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">V. Simulation of Contracts and Lease Agreements Concealing Sales<\/p>\r\n            <p>The most frequent problem in Albanian practice relates to 30-year lease contracts used as disguised forms of sale.<\/p>\r\n            \r\n            <p class=\"font-medium text-brown-deep mt-4\">1. The \"Demir Bakana\u00e7i\" Case<\/p>\r\n            <p>In decision no. 00-2022-4596 (393), dated 26.10.2022, the Supreme Court analyzed a lease contract where the parties had declared that:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-3 font-serif\">\"the contract was also considered a contract of sale and that the payment of rent represented the full price of the land.\"<\/p>\r\n            <p>The Court highlighted that the formal name of the contract was not decisive and that the real intent of the parties had to be analyzed. However, the Court emphasized that the lack of consent from all co-owners barred the validity of the ownership transfer.<\/p>\r\n\r\n            <p class=\"font-medium text-brown-deep mt-4\">2. The \"Alltane Potja\" Case<\/p>\r\n            <p>An almost identical situation is presented in decision no. 00-2023-718 (116), dated 08.03.2023. The lease contract contained a clause stating that:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-3 font-serif\">\"the payment of rent was considered a purchase price and the parties would formalize the sale as soon as registration procedures were completed.\"<\/p>\r\n            <p>Here too, the Court confronted the relationship between simulation, possession, and acquisitive prescription.<\/p>\r\n\r\n            <p class=\"font-medium text-brown-deep mt-4\">3. The \"P\u00ebllumb Alliu\" Case<\/p>\r\n            <p>In decision no. 00-2023-2397 (397), dated 14.06.2023, the Court analyzed a similar relationship arising from a long-term lease contract over agricultural land acquired through an AMTP.<\/p>\r\n            <p>From the comparison of these decisions, a common principle emerges:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-3 font-serif\">\"simulation does not automatically exclude the existence of a title for the purpose of Article 168 CC; what matters is the real intent of the parties and the nature of the possession.\"<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">VI. Good Faith and Bad Faith<\/p>\r\n            <p>Good faith is the element that distinguishes Article 168 from Article 169 of the Civil Code. AMTP and Family Co-ownership<\/p>\r\n            <p>One of the most important jurisprudential developments relates to the legal nature of the AMTP (Land Acquisition Certificate).<\/p>\r\n            <p class=\"font-medium text-brown-deep mt-4\">1. The Ibrahimi Decision (2024)<\/p>\r\n            <p>In the decision dated 19.07.2024, the Supreme Court analyzed property acquired via AMTP by an agricultural family and verified the family composition existing at the time of land distribution.<\/p>\r\n            \r\n            <p class=\"font-medium text-brown-deep mt-4\">2. The Bakana\u00e7i and Bregasi Decisions<\/p>\r\n            <p>In the Bakana\u00e7i and Bregasi decisions, the Court faced the sale of land acquired via AMTP executed by only a portion of the co-owners. From these decisions, a consolidated standard emerges:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-3 font-serif\">\"the AMTP does not create individual ownership for the head of the household.\"<\/p>\r\n            <p>Owners are all members of the agricultural family who appeared in the family certificate at the moment of land distribution. This interpretation has a direct impact on the validity of contracts, the existence of good faith, and the overall analysis of Article 168 CC.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">VIII. Possession and its Continuity<\/p>\r\n            <p class=\"no-indent\">Possession must be:<\/p>\r\n            <ul class=\"space-y-1 pl-5 list-disc mb-4 text-gray-700 text-sm sm:text-base\">\r\n                <li>public;<\/li>\r\n                <li>peaceful;<\/li>\r\n                <li>uninterrupted;<\/li>\r\n                <li>exercised as an owner (animo domini).<\/li>\r\n            <\/ul>\r\n            \r\n            <p class=\"font-medium text-brown-deep mt-4\">The Endrit Qoqja Case<\/p>\r\n            <p>In decision no. 00-2023-4725 (665), the Court analyzed the multi-year possession of an inherited property by the heirs of the Qoqja family.<\/p>\r\n            \r\n            <p class=\"font-medium text-brown-deep mt-4\">The Gjene Pa\u00e7i Case<\/p>\r\n            <p>In decision no. 00-2022-528 (35), the Court dealt with the conflict between long-term possession and formal property registration.<\/p>\r\n            <p class=\"no-indent\">From these decisions, it follows that:<\/p>\r\n            <ul class=\"space-y-1 pl-5 list-disc mb-4 text-gray-700 text-sm sm:text-base\">\r\n                <li>possession must be specifically proven;<\/li>\r\n                <li>periods of possession can be joined in case of inheritance;<\/li>\r\n                <li>formal registration is not enough to automatically exclude the analysis of acquisitive prescription.<\/li>\r\n            <\/ul>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">IX. Limits of Civil Circulation<\/p>\r\n            <p>The Supreme Court has consistently held the position that acquisitive prescription cannot be applied to assets outside civil circulation, inalienable properties, or categories of properties protected by special laws. In these cases, the legal possibility of transferring ownership itself is missing. Consequently, even multi-year possession remains legally irrelevant for the purpose of acquiring ownership.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">X. Conclusions<\/p>\r\n            <p>The analysis of the Supreme Court's jurisprudence indicates that the institute of acquisitive prescription is no longer interpreted in a formalistic manner, but rather in light of the legal and factual reality of possession.<\/p>\r\n            <p class=\"no-indent\">From the analyzed decisions, several fundamental principles emerge:<\/p>\r\n            <ol class=\"space-y-2 pl-5 list-decimal text-gray-700 mb-6 text-sm sm:text-base\">\r\n                <li>Not every absolute invalidity excludes Article 168 CC.<\/li>\r\n                <li>Simulation does not automatically exclude the existence of title.<\/li>\r\n                <li>The real intent of the parties prevails over the formal name of the contract.<\/li>\r\n                <li>Good faith remains the central element of the 10-year term.<\/li>\r\n                <li>AMTP creates family co-ownership.<\/li>\r\n                <li>Possession must be public, peaceful, and uninterrupted.<\/li>\r\n                <li>Assets outside civil circulation cannot be acquired via acquisitive prescription.<\/li>\r\n            <\/ol>\r\n            <p>In this manner, the Supreme Court's jurisprudence has established a robust interpretative standard that seeks to balance legal certainty with the protection of long-established factual situations, turning acquisitive prescription into an important instrument for the stability of civil relationships.<\/p>\r\n        <\/article>\r\n\r\n        <article id=\"lang-it\" class=\"content-section\">\r\n            <h2 class=\"serif text-xl sm:text-2xl md:text-3xl text-brown-deep mb-6 md:mb-8 border-b border-gold\/20 pb-4 leading-snug\">L'interpretazione dell'Articolo 168 del Codice Civile in relazione a simulazione, possesso, buona fede, AMTP e limiti alla circolazione civile<\/h2>\r\n            \r\n            <p class=\"drop-cap\">L'istituto dell'usucapione (prescrizione acquisitiva) rappresenta uno dei meccanismi pi\u00f9 importanti per l'acquisto della propriet\u00e0 nel diritto civile albanese. La sua importanza \u00e8 aumentata in particolare durante il periodo di transizione della propriet\u00e0 successivo al 1991, quando un numero considerevole di rapporti giuridici su beni immobili si \u00e8 sviluppato in assenza di una completa formalizzazione legale, attraverso contratti informali, accordi simulati o possessi a lungo termine.<\/p>\r\n\r\n            <p>La giurisprudenza della Corte Suprema ha svolto un ruolo decisivo nel consolidare gli standard interpretativi dell'articolo 168 del Codice Civile, affrontando problematiche legate alla natura del titolo giuridico, alla simulazione dei contratti, alla buona fede del possessore, agli effetti dell'AMTP e ai limiti della circolazione civile.<\/p>\r\n\r\n            <p>L'analisi di queste decisioni mostra un'evoluzione della giurisprudenza verso la tutela della realt\u00e0 giuridica e fattuale del possesso, senza pregiudicare la certezza del diritto e le regole fondamentali della circolazione civile.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">II. Concetto giuridico di usucapione (prescrizione acquisitiva)<\/p>\r\n            <p>L'usucapione \u00e8 un modo di acquisto originario della propriet\u00e0 mediante il possesso di un bie per un determinato periodo di tempo e alle condizioni previste dalla legge.<\/p>\r\n\r\n            <div class=\"bg-white p-5 sm:p-8 rounded-xl md:rounded-2xl border-l-4 md:border-l-8 border-gold shadow-md my-8 md:my-10\">\r\n                <h3 class=\"serif text-lg sm:text-xl mb-3 md:mb-4 font-bold text-brown-deep\">Ai sensi dell'articolo 168 del Codice Civile, la propriet\u00e0 si acquista quando:<\/h3>\r\n                <ul class=\"space-y-3 pl-3 md:pl-4 border-l border-gold\/30 italic text-espresso text-sm sm:text-base\">\r\n                    <li>\u2022 esiste un atto giuridico finalizzato al trasferimento della propriet\u00e0;<\/li>\r\n                    <li>\u2022 il possessore \u00e8 in buona fede;<\/li>\r\n                    <li>\u2022 il possesso \u00e8 continuato ininterrottamente per 10 anni.<\/li>\r\n                <\/ul>\r\n            <\/div>\r\n\r\n            <p>Mentre ai sensi dell'articolo 169 del Codice Civile, in mancanza di titolo e buona fede, \u00e8 richiesto un possesso ventennale.<\/p>\r\n            <p>L'essenza dell'istituto risiede nella tutela della stabilit\u00e0 giuridica e delle situazioni di fatto contaminate nel tempo.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">III. Il significato di \"atto giuridico\" secondo l'articolo 168 CC<\/p>\r\n            <p>Una delle questioni pi\u00f9 importanti trattate dalla Sezione Civile riguarda il significato dell'espressione:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-4 font-serif\">\u00ab\"atto giuridico finalizzato al trasferimento della propriet\u00e0\".\u00bb<\/p>\r\n            <p>La Corte Suprema ha chiarito che questa espressione deve essere interpretata in conformit\u00e0 con l'articolo 79 del Codice Civile e comprende solo quegli atti giuridici che mirano a trasferire il diritto di propriet\u00e0.<\/p>\r\n            \r\n            <p class=\"no-indent\">Di conseguenza:<\/p>\r\n            <ul class=\"space-y-1 pl-5 list-disc mb-6 text-gray-700 text-sm sm:text-base\">\r\n                <li>non ogni rapporto giuridico costituisce un titolo;<\/li>\r\n                <li>non ogni rapporto di fatto pu\u00f2 giustificare l'articolo 168;<\/li>\r\n                <li>deve esistere un atto giuridico volto al trasferimento della propriet\u00e0.<\/li>\r\n            <\/ul>\r\n            <p>Questa interpretazione ha un'importanza fondamentale perch\u00e9 definisce i confini di applicazione del termine decennale di usucapione.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">IV. Invalidit\u00e0 assoluta e atti vietati dalla legge<\/p>\r\n            <p>Uno dei contributi pi\u00f9 significativi della giurisprudenza della Corte Suprema \u00e8 la distinzione tra l'atto giuridico assolutamente nullo e l'atto giuridico vietato dalla legge.<\/p>\r\n            <p>La Sezione Civile ha sottolineato che non ogni atto giuridico assolutamente nullo costituisce automaticamente un atto vietato dalla legge. Questa distinzione ha un'importanza cruciale per l'articolo 168 CC.<\/p>\r\n            <p>Un contratto pu\u00f2 essere assolutamente nullo per mancanza di forma, mancanza di consenso, o mancanza di poteri di disposizione, ma essere comunque considerato un titolo ai fini dell'usucapione, purch\u00e9 non violi norme imperative che tutelano l'interesse pubblico. Questo standard \u00e8 diventato uno dei pilastri principali della giurisprudenza moderna sull'usucapione.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">V. Simulazione dei contratti e contratti di locazione che celano una vendita<\/p>\r\n            <p>La problematica pi\u00f9 frequente nella prassi albanese riguarda i contratti di locazione trentennali utilizzati come forme mascherate di vendita.<\/p>\r\n            \r\n            <p class=\"font-medium text-brown-deep mt-4\">1. Il caso \u201cDemir Bakana\u00e7i\u201d<\/p>\r\n            <p>Nella decisione n. 00-2022-4596 (393), del 26.10.2022, la Corte Suprema ha analizzato un contratto di locazione in cui le parti avevano dichiarato che:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-3 font-serif\">\u00abil contratto era considerato anche come un contratto di vendita e che il pagamento del canone rappresentava l'intero prezzo del terreno.\u00bb<\/p>\r\n            <p>La Corte ha evidenziato che la denominazione formale del contratto non era decisiva e che occorreva analizzare la reale volont\u00e0 delle parti. Tuttavia, la Corte ha sottolineato che la mancanza del consenso di tutti i comproprietari impediva la validit\u00e0 del trasferimento di propriet\u00e0.<\/p>\r\n\r\n            <p class=\"font-medium text-brown-deep mt-4\">2. Il caso \u201cAlltane Potja\u201d<\/p>\r\n            <p>Una situazione quasi identica si presenta nella decisione n. 00-2023-718 (116), del 08.03.2023. Il contratto di locazione conteneva una clausola secondo cui:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-3 font-serif\">\u00abil pagamento del canone era considerato come prezzo di vendita e le parti avrebbero formalizzato la vendita non appena terminate le procedure di registrazione.\u00bb<\/p>\r\n            <p>Anche in questo caso la Corte si \u00e8 confrontata con il rapporto tra simulazione, possesso e usucapione.<\/p>\r\n\r\n            <p class=\"font-medium text-brown-deep mt-4\">3. Il caso \u201cP\u00ebllumb Alliu\u201d<\/p>\r\n            <p>Nella decisione n. 00-2023-2397 (397), del 14.06.2023, la Corte ha analizzato un rapporto simile nato da un contratto di locazione a lungo termine su un terreno agricolo ottenuto tramite AMTP.<\/p>\r\n            <p>Dal confronto di queste decisioni emerge un principio comune:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-3 font-serif\">\u00abla simulazione non esclude automaticamente l'esistenza del titolo ai fini dell'articolo 168 CC; ci\u00f2 che conta \u00e8 la reale intenzione delle parti e la natura del possesso.\u00bb<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">VI. Buona fede e mala fede<\/p>\r\n            <p>La buona fede \u00e8 l'elemento che distingue l'articolo 168 dall'articolo 169 del Codice Civile. La Corte Suprema ha valutato che la buona fede esiste quando il possessore:<\/p>\r\n            <ul class=\"space-y-1 pl-5 list-disc mb-4 text-gray-700 text-sm sm:text-base\">\r\n                <li>crede ragionevolmente di acquisire la propriet\u00e0 legalmente;<\/li>\r\n                <li>non \u00e8 a conoscenza della mancanza di poteri di disposizione del venditore;<\/li>\r\n                <li>non riconosce ostacoli giuridici che inficino la validit\u00e0 del trasferimento.<\/li>\r\n            <\/ul>\r\n            <p>Nei casi Bakana\u00e7i, Potja e Alliu, uno dei problemi centrali \u00e8 stato proprio l'analisi se l'acquirente sapesse o meno che il venditore non era l'esclusivo proprietario del bene.<\/p>\r\n\r\n            <div class=\"grid grid-cols-1 md:grid-cols-2 gap-4 md:gap-6 my-8 md:my-12\">\r\n                <div class=\"comparison-card p-6 sm:p-8 rounded-xl md:rounded-2xl shadow-xl flex flex-col justify-between\">\r\n                    <div>\r\n                        <span class=\"status-badge bg-amber-800 text-amber-200\">Buona Fede<\/span>\r\n                        <h4 class=\"serif text-base sm:text-lg font-semibold mb-2 sm:mb-3 text-gold-light\">termine di 10 anni<\/h4>\r\n                        <p class=\"text-xs sm:text-sm text-gray-300 mb-0\">Si applica ai sensi dell'articolo 168 CC quando esiste un titolo giuridico e il possessore era ragionevolmente convinto della liceit\u00e0 dell'atto.<\/p>\r\n                    <\/div>\r\n                <\/div>\r\n                <div class=\"comparison-card p-6 sm:p-8 rounded-xl md:rounded-2xl shadow-xl flex flex-col justify-between\">\r\n                    <div>\r\n                        <span class=\"status-badge bg-red-800 text-red-200\">Mala Fede<\/span>\r\n                        <h4 class=\"serif text-base sm:text-lg font-semibold mb-2 sm:mb-3 text-gold-light\">termine di 20 anni<\/h4>\r\n                        <p class=\"text-xs sm:text-sm text-gray-300 mb-0\">Si applica in mancanza di un titolo o quando il possessore era a conoscenza dei vizi legali o della mancanza di poteri del venditore.<\/p>\r\n                    <\/div>\r\n                <\/div>\r\n            <\/div>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">VII. AMTP e compropriet\u00e0 familiare<\/p>\r\n            <p>Uno dei pi\u00f9 importanti sviluppi giurisprudenziali riguarda la natura giuridica dell'AMTP (Certificato di Assegnazione della Terra).<\/p>\r\n            <p class=\"font-medium text-brown-deep mt-4\">1. La decisione Ibrahimi (2024)<\/p>\r\n            <p>Nella decisione del 19.07.2024, la Corte Suprema ha analizzato i beni ottenuti tramite AMTP da una famiglia agricola e ha evidenziato la composizione familiare esistente al momento della divisione della terra.<\/p>\r\n            \r\n            <p class=\"font-medium text-brown-deep mt-4\">2. Le decisioni Bakana\u00e7i e Bregasi<\/p>\r\n            <p>Nelle decisioni Bakana\u00e7i e Bregasi, la Corte si \u00e8 trovata di fronte alla vendita di terreni ottenuti tramite AMTP da parte di una sola porzione dei comproprietari. Da queste decisioni emerge uno standard ormai consolidato:<\/p>\r\n            <p class=\"italic bg-gray-50 border-l-2 border-gold py-2 px-4 my-3 font-serif\">\u00abl'AMTP non crea una propriet\u00e0 individuale in capo al capofamiglia.\u00bb<\/p>\r\n            <p>I proprietari sono tutti i membri della famiglia agricola che risultavano nel certificato familiare al momento della divisione della terra. Questa interpretazione ha un impatto diretto sulla validit\u00e0 dei contratti, sull'esistenza della buona fede, e sull'analisi complessiva dell'articolo 168 CC.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">VIII. Il possesso e la sua continuit\u00e0<\/p>\r\n            <p class=\"no-indent\">Il possesso deve essere:<\/p>\r\n            <ul class=\"space-y-1 pl-5 list-disc mb-4 text-gray-700 text-sm sm:text-base\">\r\n                <li>pubblico;<\/li>\r\n                <li>pacifico;<\/li>\r\n                <li>ininterrotto;<\/li>\r\n                <li>esercitato come proprietario (animo domini).<\/li>\r\n            <\/ul>\r\n            \r\n            <p class=\"font-medium text-brown-deep mt-4\">Il caso Endrit Qoqja<\/p>\r\n            <p>Nella decisione n. 00-2023-4725 (665), la Corte ha analizzato il possesso pluriennale di un bene ereditario da parte degli eredi della famiglia Qoqja.<\/p>\r\n            \r\n            <p class=\"font-medium text-brown-deep mt-4\">Il caso Gjene Pa\u00e7i<\/p>\r\n            <p>Nella decisione n. 00-2022-528 (35), la Corte si \u00e8 trovata di fronte al conflitto tra possesso a lungo termine e registrazione formale della propriet\u00e0.<\/p>\r\n            <p class=\"no-indent\">Da queste decisioni risulta che:<\/p>\r\n            <ul class=\"space-y-1 pl-5 list-disc mb-4 text-gray-700 text-sm sm:text-base\">\r\n                <li>il possesso deve essere provato concretamente;<\/li>\r\n                <li>i periodi di possesso possono essere uniti in caso di successione;<\/li>\r\n                <li>la registrazione formale non \u00e8 sufficiente per escludere automaticamente l'analisi dell'usucapione.<\/li>\r\n            <\/ul>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">IX. I limiti della circolazione civile<\/p>\r\n            <p>La Corte Suprema ha costantemente mantenuto la posizione secondo cui l'usucapione non pu\u00f2 essere applicata su beni fuori dalla circolazione civile, beni inalienabili, o categorie di beni protetti da leggi speciali. In questi casi manca la stessa possibilit\u00e0 giuridica di trasferire la propriet\u00e0. Di conseguenza, anche il possesso pluriennale rimane giuridicamente irrilevante ai fini dell'acquisto della propriet\u00e0.<\/p>\r\n\r\n            <p class=\"font-semibold text-brown-deep mt-6 text-lg sm:text-xl\">X. Ky dallim ka r\u00ebnd\u00ebsi vendimtare p\u00ebr nenin 168 KC. Ky standard \u00ebsht\u00eb b\u00ebr\u00eb nj\u00eb nga shtyllat kryesore t\u00eb jurisprudenc\u00ebs moderne mbi parashkrimin fitues. V. Simulimi i kontratave dhe kontratat e qiras\u00eb q\u00eb fshehin shitjen Problematika m\u00eb e shpesht\u00eb n\u00eb praktik\u00ebn shqiptare lidhet me kontratat e qiras\u00eb 30-vje\u00e7are t\u00eb p\u00ebrdorura si forma t\u00eb maskuara shitjeje. 1. \u00c7\u00ebshtja \u201cDemir Bakana\u00e7i\u201d N\u00eb vendimin nr. 00-2022-4596 (393), dat\u00eb 26.10.2022, Gjykata e Lart\u00eb analizoi nj\u00eb kontrat\u00eb qiraje ku pal\u00ebt kishin deklaruar se: \u00abkontrata konsiderohej edhe si kontrat\u00eb shitjeje dhe se pagesa e qiras\u00eb p\u00ebrfaq\u00ebsonte \u00e7mimin e plot\u00eb t\u00eb tok\u00ebs.\u00bb Gjykata evidentoi se em\u00ebrtimi formal i kontrat\u00ebs nuk ishte vendimtar dhe se duhej analizuar vullneti real i pal\u00ebve. Megjithat\u00eb, Gjykata theksoi se munges\u00eb e p\u00eblqimit t\u00eb t\u00eb gjith\u00eb bashk\u00ebpronar\u00ebve pengonte vlefshm\u00ebrin\u00eb e transferimit t\u00eb pron\u00ebsis\u00eb. 2. \u00c7\u00ebshtja \u201cAlltane Potja\u201d Nj\u00eb situat\u00eb pothuajse identike paraqitet n\u00eb vendimin nr. 00-2023-718 (116), dat\u00eb 08.03.2023. Kontrata e qiras\u00eb p\u00ebrmbante klauzol\u00eb sipas s\u00eb cil\u00ebs: \u00abpagesa e qiras\u00eb konsiderohej \u00e7mim shitjeje dhe pal\u00ebt do t\u00eb formalizonin shitjen sapo t\u00eb p\u00ebrfundonin procedurat e regjistrimit.\u00bb Edhe k\u00ebtu Gjykata u p\u00ebrball me raportin nd\u00ebrmjet simulimit, posedimit dhe parashkrimit fitues. 3. \u00c7\u00ebshtja \u201cP\u00ebllumb Alliu\u201d N\u00eb vendimin nr. 00-2023-2397 (397), dat\u00eb 14.06.2023, Gjykata analizoi nj\u00eb marr\u00ebdh\u00ebnie t\u00eb ngjashme t\u00eb lindur nga nj\u00eb kontrat\u00eb qiraje afatgjat\u00eb mbi tok\u00eb bujq\u00ebsore t\u00eb p\u00ebrfituar me AMTP. Nga krahasimi i k\u00ebtyre vendimeve rezulton nj\u00eb parim i p\u00ebrbashk\u00ebt: \u00absimulimi nuk p\u00ebrjashton automatikisht ekzistenc\u00ebn e titullit p\u00ebr efekt t\u00eb nenit 168 KC; r\u00ebnd\u00ebsi ka q\u00ebllimi real i pal\u00ebve dhe natyra e posedimit.\u00bb VI. Mir\u00ebbesimi dhe keqbesimi Mir\u00ebbesimi \u00ebsht\u00eb elementi q\u00eb dallon nenin 168 nga neni 169 i Kodit Civil. Gjykata e Lart\u00eb ka vler\u00ebsuar se mir\u00ebbesimi ekziston kur poseduesi: beson n\u00eb m\u00ebnyr\u00eb t\u00eb arsyeshme se po fiton pron\u00ebn ligj\u00ebrisht; nuk ka dijeni p\u00ebr munges\u00ebn e tagrave t\u00eb shit\u00ebsit; nuk njeh pengesa juridike q\u00eb cenojn\u00eb vlefshm\u00ebrin\u00eb e transferimit. N\u00eb \u00e7\u00ebshtjet Bakana\u00e7i, Potja dhe Alliu, nj\u00eb nga problemet qendrore ishte pik\u00ebrisht analiza n\u00ebse bler\u00ebsi e dinte ose jo se shit\u00ebsi nuk ishte pronar ekskluziv i pasuris\u00eb. Mir\u00ebbesimi afati 10-vje\u00e7ar Zbatohet sipas Nenit 168 KC kur ekziston titulli juridik dhe poseduesi ka qen\u00eb i bindur n\u00eb m\u00ebnyr\u00eb t\u00eb arsyeshme p\u00ebr ligjshm\u00ebrin\u00eb e veprimit. Vendimet Bakana\u00e7i dhe Bregasi N\u00eb vendimet Bakana\u00e7i dhe Bregasi, Gjykata u p\u00ebrball me shitje t\u00eb tok\u00ebs s\u00eb p\u00ebrfituar me AMTP vet\u00ebm nga nj\u00eb pjes\u00eb e bashk\u00ebpronar\u00ebve. Nd\u00ebrsa sipas nenit 169 t\u00eb Kodit Civil, n\u00eb munges\u00eb t\u00eb titullit dhe mir\u00ebbesimit k\u00ebrkohet posedim 20-vje\u00e7ar. Thelbi i institutit q\u00ebndron n\u00eb mbrojtjen e stabilitetit juridik dhe t\u00eb situatave faktike t\u00eb konsoliduara n\u00eb koh\u00eb. III. R\u00ebnd\u00ebsia e tij \u00ebsht\u00eb shtuar ve\u00e7an\u00ebrisht gjat\u00eb periudh\u00ebs s\u00eb tranzicionit t\u00eb pron\u00ebsis\u00eb pas vitit 1991, kur nj\u00eb num\u00ebr i konsideruesh\u00ebm marr\u00ebdh\u00ebniesh juridike mbi pasurit\u00eb e paluajtshme u zhvilluan n\u00eb munges\u00eb t\u00eb formalizimit t\u00eb plot\u00eb ligjor, p\u00ebrmes kontratave informale, marr\u00ebveshjeve t\u00eb simuluara ose posedimeve afatgjata. Jurisprudenca e Gjykat\u00ebs s\u00eb Lart\u00eb ka luajtur rol vendimtar n\u00eb konsolidimin e standardeve interpretative t\u00eb nenit 168 t\u00eb Kodit Civil, duke trajtuar problematika q\u00eb lidhen me natyr\u00ebn e titullit juridik, simulimin e kontratave, mir\u00ebbesimin e poseduesit, efektet e AMTP-s\u00eb dhe kufijt\u00eb e qarkullimit civil. Analiza e k\u00ebtyre vendimeve tregon nj\u00eb evolucion t\u00eb jurisprudenc\u00ebs drejt mbrojtjes s\u00eb realitetit juridik dhe faktik t\u00eb posedimit, pa cenuar sigurin\u00eb juridike dhe rregullat themelore t\u00eb qarkullimit civil. II. Kuptimi juridik i parashkrimit fitues Parashkrimi fitues \u00ebsht\u00eb m\u00ebnyr\u00eb origjinare e fitimit t\u00eb pron\u00ebsis\u00eb n\u00ebp\u00ebrmjet posedimit t\u00eb nj\u00eb sendi p\u00ebr nj\u00eb periudh\u00eb t\u00eb caktuar kohe dhe n\u00eb kushtet e parashikuara nga ligji. Sipas nenit 168 t\u00eb Kodit Civil, pron\u00ebsia fitohet kur: \u2022 ekziston nj\u00eb veprim juridik q\u00eb ka p\u00ebr q\u00ebllim kalimin e pron\u00ebsis\u00eb; \u2022 poseduesi \u00ebsht\u00eb n\u00eb mir\u00ebbesim; \u2022 posedimi ka vazhduar p\u00ebr 10 vjet pa nd\u00ebrprerje. Nd\u00ebrsa sipas nenit 169 t\u00eb Kodit Civil, n\u00eb munges\u00eb t\u00eb titullit dhe mir\u00ebbesimit k\u00ebrkohet posedim 20-vje\u00e7ar. Thelbi i institutit q\u00ebndron n\u00eb mbrojtjen e stabilitetit juridik dhe t\u00eb situatave faktike t\u00eb konsoliduara n\u00eb koh\u00eb. III. Kuptimi i \u201cveprimit juridik\u201d sipas nenit 168 KC Nj\u00eb nga \u00e7\u00ebshtjet m\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb trajtuara nga Kolegji Civil lidhet me kuptimin e shprehjes: \u00ab\u201cveprim juridik q\u00eb ka p\u00ebr q\u00ebllim kalimin e pron\u00ebsis\u00eb\u201d.\u00bb Gjykata e Lart\u00eb ka sqaruar se kjo shprehje duhet interpretuar n\u00eb p\u00ebrputhje me nenin 79 t\u00eb Kodit Civil dhe p\u00ebrfshin vet\u00ebm ato veprime juridike q\u00eb synojn\u00eb transferimin e s\u00eb drejt\u00ebs s\u00eb pron\u00ebsis\u00eb. P\u00ebr rrjedhoj\u00eb: jo \u00e7do marr\u00ebdh\u00ebnie juridike p\u00ebrb\u00ebn titull; jo \u00e7do marr\u00ebdh\u00ebnie faktike mund t\u00eb justifikoj\u00eb nenin 168; duhet t\u00eb ekzistoj\u00eb nj\u00eb akt juridik q\u00eb synon kalimin e pron\u00ebsis\u00eb. Ky interpretim ka r\u00ebnd\u00ebsi themelore sepse p\u00ebrcakton kufijt\u00eb e aplikimit t\u00eb afatit 10-vje\u00e7ar t\u00eb parashkrimit fitues. IV. Pavlefshm\u00ebria absolute dhe veprimi i ndaluar nga ligji Nj\u00eb nga kontributet m\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb jurisprudenc\u00ebs s\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb \u00ebsht\u00eb dallimi nd\u00ebrmjet veprimit juridik absolutisht t\u00eb pavlefsh\u00ebm dhe veprimit juridik t\u00eb ndaluar nga ligji. Kolegji Civil ka theksuar se jo \u00e7do veprim juridik absolutisht i pavlefsh\u00ebm p\u00ebrb\u00ebn automatikisht veprim t\u00eb ndaluar nga ligji. Ky dallim ka r\u00ebnd\u00ebsi vendimtare p\u00ebr nenin 168 KC. Nj\u00eb kontrat\u00eb mund t\u00eb jet\u00eb absolutisht e pavlefshme p\u00ebr munges\u00eb forme, p\u00ebr munges\u00eb p\u00eblqimi, ose p\u00ebr munges\u00eb tagrash, por p\u00ebrs\u00ebri t\u00eb konsiderohet titull p\u00ebr efekt t\u00eb parashkrimit fitues, p\u00ebr sa koh\u00eb nuk cenon norma urdh\u00ebruese q\u00eb mbrojn\u00eb interesin publik. Ky standard \u00ebsht\u00eb b\u00ebr\u00eb nj\u00eb nga shtyllat kryesore t\u00eb jurisprudenc\u00ebs moderne mbi parashkrimin fitues. V. Simulimi i kontratave dhe kontratat e qiras\u00eb q\u00eb fshehin shitjen Problematika m\u00eb e shpesht\u00eb n\u00eb praktik\u00ebn shqiptare lidhet me kontratat e qiras\u00eb 30-vje\u00e7are t\u00eb p\u00ebrdorura si forma t\u00eb maskuara shitjeje. 1. \u00c7\u00ebshtja \u201cDemir Bakana\u00e7i\u201d N\u00eb vendimin nr. 00-2022-4596 (393), dat\u00eb 26.10.2022, Gjykata e Lart\u00eb analizoi nj\u00eb kontrat\u00eb qiraje ku pal\u00ebt kishin deklaruar se: \u00abkontrata konsiderohej edhe si kontrat\u00eb shitjeje dhe se pagesa e qiras\u00eb p\u00ebrfaq\u00ebsonte \u00e7mimin e plot\u00eb t\u00eb tok\u00ebs.\u00bb Gjykata evidentoi se em\u00ebrtimi formal i kontrat\u00ebs nuk ishte vendimtar dhe se duhej analizuar vullneti real i pal\u00ebve. Megjithat\u00eb, Gjykata theksoi se munges\u00eb e p\u00eblqimit t\u00eb t\u00eb gjith\u00eb bashk\u00ebpronar\u00ebve pengonte vlefshm\u00ebrin\u00eb e transferimit t\u00eb pron\u00ebsis\u00eb. 2. \u00c7\u00ebshtja \u201cAlltane Potja\u201d Nj\u00eb situat\u00eb pothuajse identike paraqitet n\u00eb vendimin nr. 00-2023-718 (116), dat\u00eb 08.03.2023. Kontrata e qiras\u00eb p\u00ebrmbante klauzol\u00eb sipas s\u00eb cil\u00ebs: \u00abpagesa e qiras\u00eb konsiderohej \u00e7mim shitjeje dhe pal\u00ebt do t\u00eb formalizonin shitjen sapo t\u00eb p\u00ebrfundonin procedurat e regjistrimit.\u00bb Edhe k\u00ebtu Gjykata u p\u00ebrball me raportin nd\u00ebrmjet simulimit, posedimit dhe parashkrimit fitues. 3. \u00c7\u00ebshtja \u201cP\u00ebllumb Alliu\u201d N\u00eb vendimin nr. 00-2023-2397 (397), dat\u00eb 14.06.2023, Gjykata analizoi nj\u00eb marr\u00ebdh\u00ebnie t\u00eb ngjashme t\u00eb lindur nga nj\u00eb kontrat\u00eb qiraje afatgjat\u00eb mbi tok\u00eb bujq\u00ebsore t\u00eb p\u00ebrfituar me AMTP. Nga krahasimi i k\u00ebtyre vendimeve rezulton nj\u00eb parim i p\u00ebrbashk\u00ebt: \u00absimulimi nuk p\u00ebrjashton automatikisht ekzistenc\u00ebn e titullit p\u00ebr efekt t\u00eb nenit 168 KC; r\u00ebnd\u00ebsi ka q\u00ebllimi real i pal\u00ebve dhe natyra e posedimit.\u00bb VI. Mir\u00ebbesimi dhe keqbesimi Mir\u00ebbesimi \u00ebsht\u00eb elementi q\u00eb dallon nenin 168 nga neni 169 i Kodit Civil. Gjykata e Lart\u00eb ka vler\u00ebsuar se mir\u00ebbesimi ekziston kur poseduesi: beson n\u00eb m\u00ebnyr\u00eb t\u00eb arsyeshme se po fiton pron\u00ebn ligj\u00ebrisht; nuk ka dijeni p\u00ebr munges\u00ebn e tagrave t\u00eb shit\u00ebsit; nuk njeh pengesa juridike q\u00eb cenojn\u00eb vlefshm\u00ebrin\u00eb e transferimit. N\u00eb \u00e7\u00ebshtjet Bakana\u00e7i, Potja dhe Alliu, nj\u00eb nga problemet qendrore ishte pik\u00ebrisht analiza n\u00ebse bler\u00ebsi e dinte ose jo se shit\u00ebsi nuk ishte pronar ekskluziv i pasuris\u00eb. Mir\u00ebbesimi afati 10-vje\u00e7ar Zbatohet sipas Nenit 168 KC kur ekziston titulli juridik dhe poseduesi ka qen\u00eb i bindur n\u00eb m\u00ebnyr\u00eb t\u00eb arsyeshme p\u00ebr ligjshm\u00ebrin\u00eb e veprimit. Keqbesimi afati 20-vje\u00e7ar Zbatohet n\u00eb munges\u00eb t\u00eb titullit ose kur poseduesi ka pasur dijeni p\u00ebr problemet ligjore apo munges\u00ebn e tagrave t\u00eb pronarit. VII. AMTP dhe bashk\u00ebpron\u00ebsia familjare Nj1 nga zhvillimet m\u00eb t\u00eb r\u00ebnd\u00ebsishme jurisprudenciale lidhet me natyr\u00ebn juridike t\u00eb AMTP-s\u00eb. 1.
