It fully reflects the spirit of the EU Directive and the principles of legal certainty and effective protection of economic operators.\r\n <\/p>\r\n\r\n <p>One of the aspects that has generated debate in legal and judicial practice relates to the concept of \"undertaking\" and the entities included within the scope of the law. In the existing formulation of Albanian law, unlike the provisions of the European Directive, entities carrying out economic activities as sole traders (physical commercial persons) or liberal professionals were excluded from this protection.<\/p>\r\n\r\n <p>This approach was also reflected in the jurisprudence of the Constitutional Court, which pointed out that the legislator had defined commercial legal relations entities mainly as commercial companies, excluding sole proprietors from this legal regime. It fully reflects the spirit of the EU Directive and the principles of legal certainty and effective protection of economic operators.\r\n <\/p>\r\n\r\n <p>One of the aspects that has generated debate in legal and judicial practice relates to the concept of \"undertaking\" and the entities included within the scope of the law.
