Civil, administrative, and criminal cases drag on for years, while citizens are often left without an effective remedy to seek compensation from the state for the harm caused by such delays. In this context, a natural question arises: has the time come for Albania to adopt a law similar to the Italian \u201cPinto Law\u201d?\r\n <\/p>\r\n\r\n <p>\r\n For decades, Italy faced the very same phenomenon: endless trials, congested courts, and hundreds of condemnations by the European Court of Human Rights in Strasbourg for violations of Article 6 of the European Convention on Human Rights, which guarantees the right to a fair trial within a reasonable time. For this reason, in 2001 Italy adopted Law No. 89\/2001, commonly known as the \u201cPinto Law,\u201d granting citizens the right to seek financial compensation when judicial proceedings are unjustifiably prolonged.\r\n <\/p>\r\n\r\n <p>Today, Albania finds itself in a very similar situation.<\/p>\r\n\r\n <h2 class=\"luxury-title text-2xl md:text-3xl font-bold brown-text mt-16 mb-6\">The right to a trial within a reasonable time<\/h2>\r\n <p>\r\n Article 6 of the European Convention on Human Rights provides that every individual has the right to have their case heard \u201cwithin a reasonable time\u201d by an independent and impartial tribunal. This standard is also part of the Albanian legal order and is directly linked to:\r\n <\/p>\r\n\r\n <div class=\"grid md:grid-cols-2 gap-4 my-8\">\r\n <div class=\"flex items-center space-x-3 p-4 bg-stone-50 border-l-2 gold-border\">\r\n <span class=\"gold-accent\">\u2726<\/span>\r\n <span class=\"text-sm uppercase tracking-wide font-bold\">The right to due process<\/span>\r\n <\/div>\r\n <div class=\"flex items-center space-x-3 p-4 bg-stone-50 border-l-2 gold-border\">\r\n <span class=\"gold-accent\">\u2726<\/span>\r\n <span class=\"text-sm uppercase tracking-wide font-bold\">Legal certainty<\/span>\r\n <\/div>\r\n <div class=\"flex items-center space-x-3 p-4 bg-stone-50 border-l-2 gold-border\">\r\n <span class=\"gold-accent\">\u2726<\/span>\r\n <span class=\"text-sm uppercase tracking-wide font-bold\">Public trust in justice<\/span>\r\n <\/div>\r\n <div class=\"flex items-center space-x-3 p-4 bg-stone-50 border-l-2 gold-border\">\r\n <span class=\"gold-accent\">\u2726<\/span>\r\n <span class=\"text-sm uppercase tracking-wide font-bold\">Effective protection of property<\/span>\r\n <\/div>\r\n <\/div>\r\n\r\n <p>However, Albanian practice has shown that this right often remains merely formal.<\/p>\r\n\r\n <h2 class=\"luxury-title text-2xl font-bold brown-text mt-16 mb-4\">Albania and Strasbourg condemnations<\/h2>\r\n <p>\r\n The European Court of Human Rights has repeatedly condemned Albania for unjustified delays in judicial proceedings and for the lack of effective remedies. One of the most significant cases is \u201cARB SHPK and Others v. However, the vetting process resulted in a severe shortage of judges, leading to thousands of backlogged cases and multi-year waiting periods. Strasbourg emphasized that even a necessary reform cannot indefinitely justify violations of the right to trial within a reasonable time.\r\n <\/p>\r\n\r\n <h2 class=\"luxury-title text-2xl font-bold brown-text mt-16 mb-4\">What does the Italian \u201cPinto Law\u201d provide?<\/h2>\r\n <p>\r\n The Italian Pinto Law provides for financial compensation for every year of delay, even without necessarily waiting for a Strasbourg judgment. Cause civili, amministrative e penali si trascinano per anni, mentre i cittadini spesso rimangono privi di uno strumento efficace per chiedere allo Stato un risarcimento per i danni causati da tali ritardi. In questo contesto nasce spontaneamente la domanda: \u00e8 arrivato il momento che anche l\u2019Albania adotti una legge simile alla \u201cLegge Pinto\u201d italiana?\r\n <\/p>\r\n\r\n <p>\r\n L\u2019Italia ha affrontato per decenni lo stesso fenomeno: processi interminabili, tribunali paralizzati e centinaia di condanne da parte della Corte Europea dei Diritti dell\u2019Uomo di Strasburgo per violazione dell\u2019articolo 6 della Convenzione Europea. Proprio per questo motivo, nel 2001 l\u2019Italia ha adottato la Legge n. 89\/2001, nota come \u201cLegge Pinto\u201d, che riconosce ai cittadini il diritto di chiedere un risarcimento economico.\r\n <\/p>\r\n\r\n <p>Anche l\u2019Albania oggi si trova in una situazione molto simile.<\/p>\r\n\r\n <h2 class=\"luxury-title text-2xl md:text-3xl font-bold brown-text mt-16 mb-6\">Il diritto a un processo entro un termine ragionevole<\/h2>\r\n <p>\r\n L\u2019articolo 6 della Convenzione Europea dei Diritti dell\u2019Uomo prevede che ogni persona abbia diritto affinch\u00e9 la propria causa sia esaminata \u201centro un termine ragionevole\u201d. Tuttavia, il processo di vetting ha causato una grave carenza di giudici, provocando migliaia di fascicoli arretrati. Strasburgo ha precisato che ci\u00f2 non pu\u00f2 giustificare indefinitamente la violazione del diritto a un processo entro un termine ragionevole.\r\n <\/p>\r\n\r\n <h2 class=\"luxury-title text-2xl font-bold brown-text mt-16 mb-4\">Cosa prevede la \u201cLegge Pinto\u201d in Italia?<\/h2>\r\n <p>\r\n La Legge Pinto riconosce al cittadino il diritto di chiedere un risarcimento economico per ogni anno di ritardo. Civil, administrative, and criminal cases drag on for years, while citizens are often left without an effective remedy to seek compensation from the state for the harm caused by such delays. In this context, a natural question arises: has the time come for Albania to adopt a law similar to the Italian \u201cPinto Law\u201d?\r\n <\/p>\r\n\r\n <p>\r\n For decades, Italy faced the very same phenomenon: endless trials, congested courts, and hundreds of condemnations by the European Court of Human Rights in Strasbourg for violations of Article 6 of the European Convention on Human Rights, which guarantees the right to a fair trial within a reasonable time. For this reason, in 2001 Italy adopted Law No. 89\/2001, commonly known as the \u201cPinto Law,\u201d granting citizens the right to seek financial compensation when judicial proceedings are unjustifiably prolonged.\r\n <\/p>\r\n\r\n <p>Today, Albania finds itself in a very similar situation.<\/p>\r\n\r\n <h2 class=\"luxury-title text-2xl md:text-3xl font-bold brown-text mt-16 mb-6\">The right to a trial within a reasonable time<\/h2>\r\n <p>\r\n Article 6 of the European Convention on Human Rights provides that every individual has the right to have their case heard \u201cwithin a reasonable time\u201d by an independent and impartial tribunal. This standard is also part of the Albanian legal order and is directly linked to:\r\n <\/p>\r\n\r\n <div class=\"grid md:grid-cols-2 gap-4 my-8\">\r\n <div class=\"flex items-center space-x-3 p-4 bg-stone-50 border-l-2 gold-border\">\r\n <span class=\"gold-accent\">\u2726<\/span>\r\n <span class=\"text-sm uppercase tracking-wide font-bold\">The right to due process<\/span>\r\n <\/div>\r\n <div class=\"flex items-center space-x-3 p-4 bg-stone-50 border-l-2 gold-border\">\r\n <span class=\"gold-accent\">\u2726<\/span>\r\n <span class=\"text-sm uppercase tracking-wide font-bold\">Legal certainty<\/span>\r\n <\/div>\r\n <div class=\"flex items-center space-x-3 p-4 bg-stone-50 border-l-2 gold-border\">\r\n <span class=\"gold-accent\">\u2726<\/span>\r\n <span class=\"text-sm uppercase tracking-wide font-bold\">Public trust in justice<\/span>\r\n <\/div>\r\n <div class=\"flex items-center space-x-3 p-4 bg-stone-50 border-l-2 gold-border\">\r\n <span class=\"gold-accent\">\u2726<\/span>\r\n <span class=\"text-sm uppercase tracking-wide font-bold\">Effective protection of property<\/span>\r\n <\/div>\r\n <\/div>\r\n\r\n <p>However, Albanian practice has shown that this right often remains merely formal.<\/p>\r\n\r\n <h2 class=\"luxury-title text-2xl font-bold brown-text mt-16 mb-4\">Albania and Strasbourg condemnations<\/h2>\r\n <p>\r\n The European Court of Human Rights has repeatedly condemned Albania for unjustified delays in judicial proceedings and for the lack of effective remedies. One of the most significant cases is \u201cARB SHPK and Others v. Albania,\u201d in which Strasbourg found that proceedings lasting more than 8 years and 6 months, 7 years, and nearly 9 years, went far beyond any reasonable standard.\r\n <\/p>\r\n\r\n <div class=\"relative bg-[#faf9f6] border-l-4 gold-border px-10 py-12 my-16 shadow-sm mx-auto max-w-4xl\">\r\n <svg class=\"absolute top-6 left-6 w-10 h-10 text-stone-200\" fill=\"currentColor\" viewBox=\"0 0 24 24\">\r\n <path d=\"M14.017 21v-7.391c0-5.704 3.731-9.57 8.983-10.609l.995 2.151c-2.432.917-3.995 3.638-3.995 5.849h4v10h-9.983zm-14.017 0v-7.391c0-5.704 3.748-9.57 9-10.609l.996 2.154c-2.433.914-3.996 3.638-3.996 5.849h3.983v10h-9.983z\" \/>\r\n <\/svg>\r\n <p class=\"italic text-[#5c4033] text-xl relative z-10 pl-8 leading-relaxed\">\r\n \"Delays before the Albanian Supreme Court have become structural; the lack of judges and institutional blockages cannot indefinitely justify violations of citizens\u2019 rights.\"\r\n <\/p>\r\n <\/div>\r\n\r\n <p>In another case, Strasbourg found that proceedings had lasted more than 17 years and 9 months, considering this a flagrant violation of Article 6 of the Convention.<\/p>\r\n\r\n <h2 class=\"luxury-title text-2xl font-bold brown-text mt-16 mb-4 italic\">Judicial reform and the Albanian paradox<\/h2>\r\n <p>\r\n The 2016 justice reform aimed to increase trust, eliminate corruption, and improve efficiency. However, the vetting process resulted in a severe shortage of judges, leading to thousands of backlogged cases and multi-year waiting periods. Strasbourg emphasized that even a necessary reform cannot indefinitely justify violations of the right to trial within a reasonable time.\r\n <\/p>\r\n\r\n <h2 class=\"luxury-title text-2xl font-bold brown-text mt-16 mb-4\">What does the Italian \u201cPinto Law\u201d provide?<\/h2>\r\n <p>\r\n The Italian Pinto Law provides for financial compensation for every year of delay, even without necessarily waiting for a Strasbourg judgment. Cause civili, amministrative e penali si trascinano per anni, mentre i cittadini spesso rimangono privi di uno strumento efficace per chiedere allo Stato un risarcimento per i danni causati da tali ritardi. In questo contesto nasce spontaneamente la domanda: \u00e8 arrivato il momento che anche l\u2019Albania adotti una legge simile alla \u201cLegge Pinto\u201d italiana?\r\n <\/p>\r\n\r\n <p>\r\n L\u2019Italia ha affrontato per decenni lo stesso fenomeno: processi interminabili, tribunali paralizzati e centinaia di condanne da parte della Corte Europea dei Diritti dell\u2019Uomo di Strasburgo per violazione dell\u2019articolo 6 della Convenzione Europea. Proprio per questo motivo, nel 2001 l\u2019Italia ha adottato la Legge n. 89\/2001, nota come \u201cLegge Pinto\u201d, che riconosce ai cittadini il diritto di chiedere un risarcimento economico.\r\n <\/p>\r\n\r\n <p>Anche l\u2019Albania oggi si trova in una situazione molto simile.<\/p>\r\n\r\n <h2 class=\"luxury-title text-2xl md:text-3xl font-bold brown-text mt-16 mb-6\">Il diritto a un processo entro un termine ragionevole<\/h2>\r\n <p>\r\n L\u2019articolo 6 della Convenzione Europea dei Diritti dell\u2019Uomo prevede che ogni persona abbia diritto affinch\u00e9 la propria causa sia esaminata \u201centro un termine ragionevole\u201d. Tuttavia, il processo di vetting ha causato una grave carenza di giudici, provocando migliaia di fascicoli arretrati. Strasburgo ha precisato che ci\u00f2 non pu\u00f2 giustificare indefinitamente la violazione del diritto a un processo entro un termine ragionevole.\r\n <\/p>\r\n\r\n <h2 class=\"luxury-title text-2xl font-bold brown-text mt-16 mb-4\">Cosa prevede la \u201cLegge Pinto\u201d in Italia?<\/h2>\r\n <p>\r\n La Legge Pinto riconosce al cittadino il diritto di chiedere un risarcimento economico per ogni anno di ritardo.
